Easement and Donation/Acquisition/Resale Program

The Delaware Preservation Fund works with property owners on accepting and establishing easements on historic resources in Delaware.

A historic preservation easement is a

  • Voluntary legal agreement made between the property owner and a qualified nonprofit organization to protect a significant historic property, landscape or archeological site by restricting future development on the site.

  • Easements allow a property owner to convey a portion of his or her rights on the property to a qualified organization, thereby allowing the organization the legal authority to enforce the terms of the easement.

Historic preservation easements are used by property owners to protect the historic or natural value and uniqueness of their property; once recorded an easement is binding to current and future owners.
